These Website Terms of Use / Terms & Conditions (“Terms”) govern your access to and use of the CyberWise Training Solutions website and related online services, including our content, free assessment, scheduling, and any purchases made through the site (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2) Privacy Policy; Cookies and Tracking
Our Privacy Policy explains how we collect, use, and share information, including through tools such as Kajabi forms, Stripe/PayPal, Google Analytics, Meta Pixel, Kajabi Scheduler. By using the Site, you acknowledge our Privacy Policy and consent to data practices described there.
We may use cookies, pixels, and similar technologies for site operation, analytics, and advertising measurement. You can control cookies through your browser settings; however, blocking cookies may affect Site functionality.
3) Informational and Educational Purposes; No Professional Advice
The Site and any content provided through it (including blog posts, checklists, templates, emails, and free assessment content) are for general educational and informational purposes only.
CyberWise does not provide legal advice, regulatory advice, compliance advice, accounting advice, or guarantees of cybersecurity outcomes through the Site. You are responsible for obtaining professional advice appropriate to your situation.
4) No Guarantee of Results; Cybersecurity Risk Disclaimer
CyberWise provides education, tools, and guidance to support cybersecurity awareness and risk reduction. Cybersecurity risk cannot be eliminated, and no training, assessment, or recommendation can guarantee prevention of incidents, breaches, losses, downtime, or third-party harm.
Your results depend on many factors, including your organization’s existing controls, systems, vendors, staffing, adoption of recommendations, user behavior, and the evolving threat landscape.
5) Free Assessment Terms and Disclaimers
If you complete a free assessment or questionnaire through the Site:
- The free assessment is a high-level, point-in-time informational service based on the information you submit.
- It is not a penetration test, forensic review, certification, audit, compliance attestation, or guarantee of security.
- We may rely on the completeness and accuracy of information you provide; we do not independently verify unless we expressly agree in writing.
- Assessment outputs are intended for your internal use and should not be relied upon by third parties.
CyberWise may choose, at its discretion, to decline or discontinue a free assessment request.
6) Purchases, Subscriptions, and Payments
Certain offerings (training packages, digital products, consulting) may be available for purchase through the Site.
- Payment Processing: Payments are processed by third parties such as Stripe and/or PayPal. CyberWise generally does not store full payment card numbers.
- Pricing/Taxes: Prices are shown at checkout and may be subject to applicable taxes.
- Refunds/Cancellations: Refund eligibility (if any) is governed by our posted Refund/Cancellation Policy and/or the terms shown at checkout. If no refund policy is posted for an offering, the purchase is presumed non-refundable unless required by law.
- Access/Delivery: Access to training materials or digital products may be delivered via our platform (e.g., Kajabi) and may require account creation.
7) Scheduling (Kajabi Scheduler)
If you schedule a call through Kajabi Scheduler, you agree to provide accurate information and to comply with any rescheduling/cancellation rules displayed at booking. We may reschedule or cancel appointments if necessary.
8) Email and Marketing Communications (Kajabi)
If you opt in to receive emails or download resources, we may send you transactional messages and marketing communications via Kajabi. You can opt out of marketing emails at any time using the unsubscribe link in the email. Transactional or service communications (e.g., purchase confirmations) may continue as needed.
9) Intellectual Property; Limited License
All Site content—including text, graphics, logos, course materials, videos, downloads, assessments, templates, and the overall “look and feel”—is owned by CyberWise or its licensors and protected by intellectual property laws.
You may view, download, and print materials for your personal or internal business use only, solely as permitted by these Terms or by a written agreement with CyberWise.
You may not (without our prior written consent):
- Copy, reproduce, modify, publish, distribute, sell, license, or create derivative works from our content
- Share course access with unauthorized users
- Resell, white-label, or redistribute training materials or templates
- Remove copyright/trademark notices
10) Acceptable Use; Prohibited Conduct
You agree not to:
- Use the Site for unlawful, harmful, or fraudulent purposes
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with the Site’s operation (e.g., malware, denial-of-service, scraping at scale)
- Reverse engineer or circumvent access controls
- Impersonate any person or misrepresent affiliation
- Collect personal information from the Site without authorization
We may suspend or terminate access for violations.
11) User Submissions
If you submit information via forms, surveys, scheduling tools, or messages, you represent that you have the right to provide it and that it is accurate to the best of your knowledge. You agree not to submit content that is unlawful, defamatory, infringing, or harmful.
12) Third-Party Services and Links
The Site may integrate or link to third-party services (including Kajabi, Stripe, PayPal, Google, Meta, Kajabi Scheduler, and Mailchimp) or third-party websites. We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms and privacy policies.
13) Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERWISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERWISE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR SECURITY INCIDENT-RELATED LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERWISE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO CYBERWISE THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
(Some jurisdictions do not allow certain limitations; in that case, liability is limited to the greatest extent permitted by law.)
15) Indemnification
You agree to indemnify and hold harmless CyberWise from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, or your infringement of any intellectual property or other rights.
16) Professional Services; Order of Precedence
If you engage CyberWise for paid professional services (training and/or consulting), those services will be governed by a separate written agreement (e.g., Master Services Agreement (MSA) and Statement of Work (SOW)). If there is a conflict between those agreements and these Terms, the MSA/SOW will control for the professional services.

17) Termination
We may suspend or terminate your access to the Site at any time for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnity) will survive.
18) Governing Law; Venue
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Linn County, Iowa, and you consent to personal jurisdiction there.
19) Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date indicates when changes were made. Your continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
